A federal judge has ruled the prompt release of Kilmar Abrego Garcia from detention by ICE, finding his ongoing detainment lacks legal authority.

"Since his release after wrongful imprisonment in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis wrote in her ruling.

The case originates in a erroneous removal to El Salvador in March, which the government later acknowledged was an mistake. After his return to the United States to face alien smuggling allegations, he was held in federal custody.

In her decision, the court pointed out that the authorities does not have a valid deportation order, which effectively blocks them from removing Mr. Abrego Garcia "at this time."
